bjhelp.jpg - 7.20 K Durango, Colorado—Tyson Eugene Sampson, 24, of Cherokee, N.C attended an August 30 party here with a Fort Lewis College roommate where both admitted to drinking heavily. Sampson testified he felt he was "receiving signals" from his roommate indicating an interest in him and that when they returned to their bedroom, at some point Sampson decided to make a pass, joining his roommate in bed and initiating oral sex.

Sampson claimed that at first his intended was "responding" by touching, but that then he'd changed his mind abruptly and had thrown him off. The roommate claimed he thought Sampson to be a girl who'd been interested in him at the party, and when he came out of his drunken daze for a moment and realized it was Sampson, he jumped up, ran out of the room and called 911.

Durango jury members were asked their opinions of homosexuality. The most enlightened response among them, according to activist observers, was: "It bothers me." Others had more negative mindsets.

Nevertheless, the jurors insisted that their mindsets would not affect their judgement. Sampson was convicted of first degree sexual assault on October 19 and placed in Colorado's State prison to await sentencing on December 17. On October 20, however, he was released on $10,000 bail.

The young man faces a probable 4 to 6 years in prison, with a maximum of 32 years. He will be tested over the next 60 days to determine if he is a "threat" to society.

One of the tests to which he will be subjected, reportedly, involves the placement of electrodes on his penis and a measurement of his response to various stimuli. It is possible that if the testing goes well, his sentence could be reduced.

Bail agreements specify that Sampson must remain until sentenced in La Plata County, keeping weekly appointments with a probation officer. District Attorney Sarah Law says Sampson lives on an Indian reservation in North Carolina and she is concerned that extradition laws may make it difficult for law enforcement officials to extradite Sampson should he violate the conditions of his bail by returning home.
