Virginia Denies Lesbian Mom
Chance to Adopt Foster Child

Arlington, Virginia -- Arlington resident Linda Kaufman is suing the Commonwealth of Virginia for refusing to allow her to adopt a District of Columbia foster child because Kaufman is a lesbian.

Onn May 3, Lambda Legal Staff Attorney Greg Nevins argued in opposition to Virginia's motion to dismiss Kaufman's case.

Virginia argues that Kaufman has no case because she did not formally submit an application. Kaufman was prevented from submitting an application when a Washington D.C. child welfare agency said it could not initiate a child placement because Virginia had already stated it would deny Kaufman's application.

"With this motion to dismiss, Virginia is just trying to avoid their judicial day of reckoning over its illegal and discriminatory policy," said Nevins.

He added:

"Virginia has stated that it will not approve Linda's application because she is a lesbian. Because of that, the social service agency cannot responsibly place a child with her and then be forced to crush a child's hopes of being adopted."

In 1998 and 1999, he served as the organization's key lobbyist on health and human services issues, and prior to that served as a senior staff associate and publications manager with the organization's Health Programs department, working principally on HIV/AIDS and breast cancer issues.

Headley left USCM for a brief period in 1998 to serve as executive director of the National Black Lesbian and Gay Leadership Forum (NBLGLF). After returning to USCM he remained active in NBLGLF, serving for a time as a member of its board of directors
